    Discover card attorney placement pending
    Hello,
    I received a letter from discover stating if I didn't contact them by the end of the month, my account would be forwarded to an attorney to obtain a judgment against me. I am a full time student and the only asset I have is my car which is paid in full. I'll be a student for 5 more years. Does this mean they will sue me? How do the court proceedings work and can I lose my car? It's really my only asset. Thanks so much!

    I personally believe this is just a scare tactic to get you to talk to them. I would contact them and explain your situation. Just so you know the process from not paying your bills to getting a judgment is not an overnight situation. It can take months even years. For me personally it took 3 years. My first suggestion is that you go out and get yourself a little notebook and every time you talk to discover write down the date, person you talked to, time they called, anything pertinant you discussed. If you want to only communicate via letters you need to send that to them in writing. If I had to do my situation all over that's what I would have done. I was harassed and threatened with things that weren't even true and because I was so scared of not being able to pay, I ended up in a different situation then If I had just educated myself and did the very best I could do. When you get into a better place financially you can offer them a settlement but if/when that comes into play make sure you seek the advice of an attorney. Just don't let it get out of hand, keep up to date on your account. You may not have money now but just avoiding it doesn't always make it go away.
