First its not a good idea to piggyback your post on someone else's thread. So I've moved your question it its own thread.

If there is a mortgage on it, you should ask the lender. But basically youy husbands issues a quit claim deed from himself to the both of you.

Go to the home page and click on the Real Estate Law forum. At the top of the page is a sticky with instructions for adding someone to a deed.

There are some states that require both of you be on the deed. Check to see if you're in one of them. My husband is on the deed to the house due to this, but not on the mortgage.

I'm curious about this. What state and what law in that state would require a spouse to be on the deed of their primary residence?

Alabama... they say he has to be on the deed (since we are married), but not the mortgage... it's only my name

Hmm, I would still like to know what specific statute requires it. I can't imagine that its would be required by law.
