Can anyone help me how to pay my tax.

I'm in H1B, just 6 months back I tranfered my H1b to new company, when I joined the new company, they promised me to pay LCA salary, according to that they paid me for last 5 months after deducting the TAX. And now I got a project, then I happen to that they didn't run my paystub, so they didn't pay my tax which they were deducting from my beanch pay. Can any of you people help me , how I can pay those tax for the last 6 months, which they fail to pay.

If you can show the IRS that the money was withheld from your salary (a paycheck stub will do), then the IRS will approach your employer for payment of the appropriate employment taxes.

The payment of these taxes is the employer's responsibility, not yours.

Actaully they didn't give any paystubs, but they deducted the tax, then how I can do file my TAX. They actaully telling me that I'm going to get my paystubs for furture months only.

Is there anyway where we can pay our tax amounts, without the paystubs. One more thing B4 I changed my employer I worked for couple of month with my old employer, for that also I don't have my paystubs, is there anyway I can check whether my old employer paid tax for me( without paystubs).

And one more thing, since I moved to new employer, my old employer don't have contacts with me, and they don't have my new address either, so how will I get the w2 forms? Is there is anyway to pay my tax from my side for last 9 months?

For the year in question, the first thing to do is contact both the IRS and your state tax authority and find out what they have on record for you in terms of wages paid and income, Social Security and Medicare taxes withheld. If your old and current employer paid the taxes on your behalf, they should have filed the required forms with your name and Social Security number with both the IRS and your state tax authority. You can get the phone numbers for both on the Internet.

Once the IRS and your state tax authority sends you the information, find a competent tax pro and ask him/her to interpret the information for you. If the taxes were paid by your employer(s), the tax pro can construct W-2s for you from the state/IRS-provided tax information and then probably help yopu file your tax return.

If neither the IRS nor your state tax authority has any tax information for you, then it is likely your old employer and your current employer has failed to file the appropriate tax returns and, most importaant, failed to pay the taxes. In essence, they withheld your money, then kept it for themselves.

This happens far more often than you would expect. If this turns out to be the case, you can contact the IRS about the problem. They will be most interested; trust me!

However, understand that if you do so, you can expect to be fired by your current employer, as you will cost them a substantial amount of money in back taxes, fines and interest once the IRS audits their accounts and finds out that they have not paid their taxes on time as required by law. This applies even if you report only your old employer, because if the IRS finds irregularities at an old employer, they will probably check to see if your current employer is doing it right as well.

It's your decision; just understand the possible consequences!
