    Filing tax return for L1
    Hi,

    1. I was on F1 Visa for 2002 to 2004 in US and filed tax-return and applied for refund. I received tax refund too.

    2.I left US in Sep,2004.

3.I entered US on L1 Visa on June,2007 and will be here till June,2008. I am single. Federal, state and SSN tax are deudcted from my salary. Am I eligible for filing refund while filing my next year tax retun?

    Please clarify.

    Thanks

You will need to file dual-status returns for BOTH 2007 and 2008.

You MAY receive a refund for your federal and state income taxes; that depends on how much you have withheld from your paycheck. Do NOT have too much withheld, as ANY refund is an interest-free loan to the government.

You will NOT get a refund of Social Security or Medicare taxes. Sorry!

However, if your home country has a totalization agreement with the U.S. these taxes may be credited against an equivalent account in your home country.
