1. My girlfriend came here in 1999 as a student but after her 6 months visa she applied for anther six months but was refused without any notification as we found out at a later date.
We decided to get married in in April 2000 and applied for her to stay in the country in August 2000 but 5 years later after numerous letters and phone calls to the home office re was refused stay in this country. We were advised by the citizen advice bureau that she should leave the country and apply for a reentry visa.
But we decide against that and wrote to the home office again but they advise us to appel but again was advised by the citizen advise bureau not to appeal as we lose the case.
We did not appeal and she is still here in limbo and deciding what action to take.
1. Do we go to a solicitor to fight the case.
2.She goes back to Seychelles and reapply for an entry visa.

Can someone shed a light on this please as I would be very grateful.
By the way I am a british passport holder for 40 years and in full employment and a house owner and my wife has never applied for any state benefits.

Well this is when it gets messy. Just because someone marries a citizen of another country they do not automatically have the right to live in that country. When you got married and she stayed in the UK over 6 months she technically became an illegal alien. And this may not affect your day to day lives but for immigration purposes it just looks bad.

You really have 2 options, have her leave and apply for the entry permit and re-enter legally then file for her to remain in the country again. OR get a lawyer, an immigration lawyer specifically, they should be able to show that her leaving the country would cause unnecessary stress and complications for your family. I wouldn't try to fight them yourself anymore as the more appeals you lose the harder it gets. I would definitely suggest contacting a lawyer no matter which option you choose.

I have a question about how I can transfer my H1B visa from a library to a non-profit company.

I just got my H1B visa approval a couple of months ago. My H1B petitioner is a very big and famous library because I get my paychecks from the library. However, actually, I am working for a non-profit company. This company provides PCs, databases, and all other informaiton technology for the library. This company does not have any employee. All the employees (about 15 fulltime and 13 part-time) are librarians from the library. The company reimburses the library every year for the employee cost.

Starting from the end of 2007, this company will be separated from the library. All the employees including me working for the company will start to get paychecks from the company, not the library any more. The company will still reside in the same place. I wonder if and how I shall transfer my H1B from the library to the company or is it necessary for me to transfer my H1b?

Technically the H1B is employer specific so yes your new employer (the party that pays you) will have to be listed on the visa. Talk with them about doing the transfer, they may be more help then you think!

Thank you for your response! I hired an attorney when I first applied for my H1 work visa. I paid about $1500 for the lawyer fee. I wonder if I can handle the transfer by my own. My company is a non-profitable company and clearly shows that they won't be able to help me with the visa thing.

... I had just passed my 12th in commerce by 53.33% and I got 59 % in 10th std... ok... but after 8 months only of my 12th exam... I got visa in jan 06 till apr.08 of UK on student visa... on acca course but to be frank I haven't study at all over there.. and by the end of my visa on apr.08 I just came back and I little bit don't like it over there... well.. I have got my good english... so.. to.. score.. good.. bands... in ielts... is not an issue but sir... if I'll apply for student visa for NZ then my previous you student visa stamped will make my file strong or weak and even what I suppose to show in the gap of 2 years in uk.now.. sir.. I want to go to uk again on student visa so.. is.. it.. okay.. if.. I'll.. again re-apply for the uk student visa..
