    Payrol deduction while on OPT?
    Dear Expert,
    I am currently on OPT status (start date Feb 16th 2007) working for a start-up company. Social security tax and Medicare taxes are being deducted from my pay check. Do you think that I should get the refund for these deductions? I entered the United States in August of 2001.

    Normally, you would not be liable for Social Security and Medicare taxes while on OPT.

    However, because you have been in the U.S. since August, 2001, your exempt status expired on 31 December 2007, so you became liable for Social Security and Medicare taxes starting on 1 January 2006.

    Hence, no refund for Social Security and Medicare taxes; sorry!
