I do not see how you could sue the owner of the truck, since the truck was stolen. The owner of the truck will want to sue both the teenagers and the parents of those teens. You should go and talk to an attorney who specializes in accidents. Why can't you sue the parents of these teens and the teens? Are the teens under 18? Was there a police report filed? Who got the citation(s)? Did you talk to your insurance company?
You have avenues to pursue and good luck getting this resolved.
The truck owners car insurance may pay you because it hit you, but the owner of the truck has no liability if his truck was stolen.
The parents of the teen who was driving is the one at fault in the accident and would be the main one to be sued, Since this was the result of a criminal act, the other teens in the car may be able to be sued also.
You need an attorney to work this out according to your states laws.
You may not have to sue anyone. This is why YOU have insurance. What you need to do is file a claim with YOUR insurance company. They should pay out on the car and maybe on the lost wages. They will then sue the appropriate people to recover what they paid out on your behalf.
If there are expenses that your insurance doesn't cover, then you may have to sue on your own. In that case, you name everyone as plaintiffs. The insurance carrier of the vehicle owner, the driver of the car, this parents if underage and anyone else involved. You need to hire an attorney who will advise you.
Actually I'd go after both, as both have a potential liability for your damages. Even though the owner of the truck may be blameless, his liability coverage should be valid for the damage caused to you by the boys that were driving the truck, albeit without the owner's knowledge or permission. His insurance always has the option in turn of going after the parents of the boys and you should go after them as well. Did this happen during school hours and were the boys cutting school when the theft and/or accident occurred? If so, you may even have a claim against the school as well.
