Well for proff, your attorney when you file for a change in custody in court, sends for the police and jail records of your ex. Also you have your daughter tell all of this to the judge and to tell the judge she wants to live with you.

Sadly just a little drug use and one day in jail may not be enough to make her a unfit mother but your daughter saying she wants to live with you along with the problems should be enough

As far as WHAT WOULD make her unfit... drug abuse, neglect, physical/emotional abuse of your daughter, etc.

Really, a lawyer would be much better suited to outline these definitions and pursue these accusations for you. It may come down to how much of this is going on.

Contact a child/family services lawyer in your area, they will be able to help you even if your daughter and her mother live in another area.
