Hi, I have been trying to get an order for child support since December 2006. I live in a different state then the father. Although I am receiving Public assistance and they say they are working on it, nothing at all has happened. I know the location of the father , but for some reason it is taking long and nothing happens. All I get in the mail are letters form the welfare asking me if I want to continue child support enforcement over and over again.
You need to go down to the child support office and speak to someone face to face... if they don't answer your questions or get the ball rolling you ask to speak to a supervisor. There is no reason this should be taking this long.
My mother was the biggest thorn in the side of child support enforcement in our state and the state where my father resides. She was like a pitbull she latched on and never let go until they got our support money. Its unfortunate but its what you have to do. Those people are so overworked and have so many cases that sometimes things slip through the cracks unless you are there in someone's face saying EXCUSE ME!
I totally agree with you Glinda... they know me by name haha! When they don't return my calls, I call back and leave a message demanding a call from a supervisor... and SURPRISE I get a call back that same day! :)
That was my mom she knew EVERYBODY in the office. They heard her name and she would always get a call back. If she didn't get what she wanted well then she'd just show up. See them not return a call when you're in their face ;)
If I am not mistaken... you are on welfare,and it means the child support has to be collected by CSE,not by you.
GV70 I think that all support is collected via CSE. My mom never received a check directly from my father it always was filtered through CSE. However, in order to get CSE to get on top of someone to collect arrears you have to constantly be in the face of CSE as macksmom and I pointed out
No-there is no a rule that all support is collected via CSE.CSE is obligated to act when paternity is established or in other cases as it was said.A friend of mine always receive CS via bank accounts.Quote:

I do not know... I know that she receives CS every month via bank transfers and it was accepted by the court... maybe the reason is they live mostly in Europe.
I meant they had an agreement about CS and its payment and the court only registered it.
If welfare is handling it for you, then more power to them. Just cooperate with them fully. It probably will take a long time, these things typically do. But welfare will get out of him whatever there is to be gotten.
If you are being provided welfare then you must cooperate with the state for CSE to collect child support from the absent parent. They will need to establish a child support order to begin with. This involves sending dad notice he is being sought after for child support and requests to voluntarily provide his financial information. Standard is they usually have to allow for 30 days for a response from dad for this, for that and it does take forever. Especially if he doesn't respond, or make appearances. Then they have to attempt to hunt him down, which involves checking the employment social security data base by his social for an employer, which will only come up if his employer has reported him as employed. Employers, I believe, only report to this agency once per quarter. If he is working under the table, it won't be reported at all. They will want an employer so they can accurately apply his income to assign the correct child support amount. Many courts will not go forward at all if there is no employer. The case will stall. Sometimes it is possible that the court will go forward and base his income on ability to earn rather than an actual amount, but courts DO NOT like to do this. So, needless to say there are a lot of reason this could be taking forever. These are just some of the possibilities. You really need to find out who the case worker is who has your file at CSE, make sure personally that they have all the information you do, and hound them.
If you have a court order for child support through divorce or through private attorney directly with the court, CSE does not automatically collect the CS. Payments would go directly from parent to parent. If the parent took the order to CSE for enforcement and collection then the payments would to go CSE first and then be distributed to the custodial parent by check or direct deposit through bank accounts (if available).

I never had to take my child support order to CSEA. Once the order was signed off by the judge they did took care of it all, how I was going to receive the support was never even questioned, it automatically was done through CSEA. I was always sent a check from CSEA, NOT her father.
