Credit Card Garnishment - State of Georgia
I'd like to know what are my recourses... can a credit card company garnish your wages for an uncollected debt? If I can't reach an agreement with the collection agency that's been hired. Approximately how long is the process? When/if sued do I get to go to court before the judge?

Have you ever heard of Nat'l Atty Network? Do they try to collect in the same office where attorneys are located or is this a last ditch effort to collect monies?

You will need to check your state laws, I seem to recall that GA may be one of the few states to not allow salary garnishment of unsecured debt.

The process, is first they dun you. After a period that is totally up to them, they will file suit against you. From there you have to defend against the suit, which means waiting for a hearing, that could be several months depending on local courts. At the hearing, a decision may be made or it may be postponed and a new hearing set. At some point either they will be awarded a judgement or the suit dismissed. If they get a judgement, they then have to find attachable assets and get a court order to attach those assets.
