    Does he need permission to Adopt?
    I am intending to marry my fiancé in the near future I have a daughter but he is not the biological father but he is very keen to adopt her as his own, My daughter does have contact with her real father will I need his permission for my fiancé to adopt my daughter. Myself and my daughters father have never been married.

    Yes you will. The bio father must relinquish his parental rights in favor of your husband.

    What are the rights if the biological father doesn't pay child support does that still stand? (I live in England)

    Whether he pays child support or not has no bearing. However, I'm not as familiar with UK laws on this issue, so you should consult a solicitor. Under US law, you would HAVE to get his rights terminated, either voluntarily or through a court. Involuntary termination of rights is extremely hard to get.

    If he is on the birth certificate as the father, he has parental rights. If he is not on the birth certificate and learns of this, he may press issues to have a dna test performed. Make him do this at his expense, but if he is not on the b.c. then you will have to either consent for them to take dna from your daughter, or be ordered through the courts to allow them to take your daughter's dna. If he is on the b.c. you will have to go to court and fight it out, unless he agrees peaceably.

    The father will have to give his consent in order for the adoption to proceed. If he will not consent then the adoption isn't going to happen.
