Im turning 17 in one week and this past year with my dad has been terrible. I live with him and see my mom every other weekend. My dad and I do not get along and all the restrictions he gives me end up in arguments and not very often but sometimes abuse. I got arrested for something stupid that I will never do again, and when I came home he slapped me in the back of the head to where I fell on the ground and then he started kicking me, in the face and shoulder. I want to go live with my mom because I get depresssed there and can't think or speak for myself. My dad forbids me to live with my mom but I know I would be a lot less stressed and happier if I did live there. I'm willing to change schools and work I just want to get out. Is it possible to have my mom get custody of me?

If he really, really hit you and kicked you, report him ( you would have brusies to prove it) For a father to get custody there had to be a seroius issue or reason, since the mothers normally get custody unless there is a real issue that is shown in court. ** unless the women does not ask for or fight for the child.

If you want to live with your mom, she will have to make a motion in court for custody of you.

Is it more that your dad makes you follow rules and you mom would not make you have any rules,?

I don't have any bruises. I did lose my hearing for about an hour and there are 2 witnesses my mom and step mom. The police did find out because I told my therapist. My mom would make me have rules its just that my dad is old school. Im not allowed to get picked up by my step dad (who is basically my best friend) because he is a man, and I'm not allowed to do anything. If I want to go out I have to give him 24 hour notice. The love and nurturing just isn't there. My parents got divorced when I was 3 and my mom did not show up to the court because she didn't want to fight it because back then it wouldve been better to live with my dad. But now she has a husband and a 1 year old son that I love like a brother. My mom gives me rules, but not ridiculous rules. And she doesn't force me to fast or pray. She lets me be who I want to be. I asked him if I could do junior life guards over summer last year and he said no, and his reason was 'because he said so'. 80% he tells me I can't go hang out with my friends and tells me I should read a book instead. So yes it is the rules; but I want to live with my mom...
