    Prorated Rent
I am leasing a 2 bedroom condo with another girl, on a month to month least agreement. There is no stipulation in the lease agreement stating that we have to give a 30 day notice on the 1st of a month. We gave our 30 day notice on the 9th of August, that we will be out by the 9th of September. The lanlord is demanding the we pay the full month's rent for September, she says that we must pay the full month because the lease agreement states that the full amount is owed on the 1st. She will give us our money back on the 9th after the final walk through, but I feel as though she is trying to trick me because isn't the purpose of a 30 day notice to not pay rent after 30 days? Thanks so much.

    Hello Dana:

Your notice must include one complete rental period. That period would be from the 1st till the end of the month.

There is normally state rental laws that will take effect if your specific lease does not state something one way or another. Normally your notice will have to be a full ental period, so your notice should have been before the 1st for the last day of that month. The only way she will give you back any prorated rent is if they are just nice and wants to.
