    Crazy roommate
    I am a twentysix year old, female, international student. I moved into a house after my male friend who had a fifty something year old roommate. When I was moving in, all of us including landlord agreed that I will be taking the house over and will bring in a new female roommate. This old male roommate has been giving problem to my friend about moving out since christmas but since he verbaly agreed to move out in front of everyone, we all thought it should be OK. I found a girl who should move in September first. She already paid deposit and gave a notice at her old place. I informed my current roommate and everything was fine till now. He told me he is not moving out as his "new place fell throught" it's the same game as always to him. I told him she already paid but he just start yelling at me that if I don't leave him alone he will do something to my stuff and car. I am afraid of him now and since he is all the time glued to the couch in the livingroom, I feel that I can't even come out of my room. I feel very uncomfortable with him in the first place especially now after he has made those threats.
    I told my ladlord about it and he agreed that he has to go. In addition to that, I told him what he already knew, my roommate is a big time drug user.
    I would like to get along with him and just deal as two adults but obviously that's not possible as he is strictly refusing to even talk about it. He has been recently arrested and spent week in jail for driving under influence and drugs. He gets so bad that it's absolutely normal that he starts to cook and leaves the house for couple days or falls asleep. One time he almost burned the house down.
    If anyone could give me any advise on how to get rid of him as fast as possible I wolud really appreciate it. Please help!

    I think your landlord is going to have to intercede and evict him. Typically, once served an eviction the landlord must give the tenant being evicted 30 days. However, laws can vary by state.

    You and the landlord need to get him evicted. You might not be able to do it by 9/1, but you need to start the process immediately. Since he acknowledged that he was vacating by 9/1 in front of witnesses that might help. You will need to check the laws in your area to see what has to be done legally. Hopefully you can get a court order to remove him on 9/1.

    While Glinda is right, this may be an exception to the rule. This isn't a matter where you are trying to get someone out before their tenancy expires. This is a matter where they agreed to move, and a new person is ready to move in so they have to vacate as promised.

    Why wouldn't it be a legal rental? The only thing I know of that would make a home an illegal rental is if it is a an illegal two family.

    If the landord agrees that he has to go and does not want him living there anymore, then your landlord can send a sheriff to have him "personally" evicted. The Sheriff will stand there until all of his stuff is removed from the house. I would park in the garage for a while though if I were you. If he isn't to good of a guy chances are he has some real shady friends too.

    I don't think the landlord is paying taxes on the rent he colects... I am not too familiar with this but wouldn't want to the landlord to get in trouble or to even lose the place as it's a great place.

    I don't believe that would stop the landlord from going through with an eviction.

    Well than that's a good thing. I was worried that he wouldn't want to do it... This is just such a horrible situation. I feel for everyone who is going through this!! I can't believe that the law is so much on the tenant's side.
    Do u think I should go to the police and get informed on how to approach the threat issue? Or should I just let it slide and have the landlord deal with it? I just want him out. I also feel bad for my new roommate. I will have to share my room with her as she has nowhere to go.

    What I would do is check the laws in your state (you can Google eviction + state). If a tenant is being abusive they may be able to evict them without the 30 days notice. Share all this information with your landlord so that s/he can proceed.

    I would most certainly let the police know. You shouldn't have to worry about safety in your own home.

    If the LL is not paying taxes on the rental income, that wouldn't affect or come out in an eviction. As long as it isn't an "accessory" apartment in how home that he's renting its not illegal to rent a property. If he is not paying taxes on the income, the IRS will get him some other way.

    The obvious thing that comes to my mind is to go at it from more of a criminal point of view. Does he keep drugs in the house? Call the police and just make sure you're not there when they come ot bust him (because I believe they could bust you, too - even if they're not yours.) I don't have any first hand experience with this kind of thing. I just know, as a landlord, if someone is arrested for anything illegal on my property I can have them almost instantly evicted. It supercedes rent not being paid and anything else. See what your lease says about illegal activity, and maybe ask around on the criminal law forum.

    Just a thought.

    You could also check into a restraining order if he's threatened you. Especially if you have any witnesses.
