Can I stop my partner having my son circumcised

Hello.

My baby boy is being born next week and my partner is adamant that he will be circumcised (something that I am absolutely against happening). As it turns out, my partner does not need to get my consent to go ahead with the procedure and has already organised to have it done.

I am beside myself and don't know what to do in order to stop it. I was hoping that someone may know if I can stop it legally. I am prepared to leave my partner over this matter if needs be. His ideas are old fashioned and archaec and he refuses to see sense on this issue.

Can I seek some sort of legal injunction to stop it?

If he is not adjudicated as a father with custody rights he does not do anything without your permission. If you and he have shared legal custody he does not have right to do it without your agreement or Court order.

Thanks for your response. He is neither jewish nor muslim.

I have been told that the doctor will perform the procedure without my consent as they only need the consent of one parent. Is this correct?

It all depends on the doctor.Legally he does not have this right but if the doctor is willing to circumcise your son...

Give him notarized application that you do not agree with him... If he wants to do it he will lose his custody rights.

Also say him if he does it he will lose his visitation with the boy and you will only allow supervised visitation and he has to pay for it.

I'm pretty sure she will never get that if her only argument is a disagreement about circumsision.

As I stated in that thread, you need to sign a consent form for any procedure to take place on your child. Tell your doctor now, and the hospital when you arrive, that you are to be the only one signing the consents for procedures and that you do not want a circumcision done on your son. This must be made part of your official medical record.

Tough call for the sole custody as well. She has not shown any other issues between the couple other than this. If the father wanted shared custody I can't see why a judge wouldn't allow it.

If this is the same man she was on here about a while back, he was addicted to sex and seeing some rather questionable women, she may have grounds for sole custody.

That however, is based on whether this is the same man.

Thanks for your response J but the reason I wanted to find out about what I have to do to legally stop the procedure is because my partner has found a private clinic to take my son to in order to have the procedure done. He can do this at any time after we are discharged from hospital regardless.

This is a classic example of not all of the information being given in the original post. You will most likely have to contact a family law attorney to get papers in order prior to the birth if this is the situation.

OK-the last answer... you are not married to him,right? You will have sole custody until he file for custody and will be awarded with.The shared legal custody means you and he BOTH have to make decisions about a child's upbringing. A parent with legal custody can make decisions about schooling, religion, and medical care, for example. You have to go to an agreement.If you are not willing to allow him to do it,give him notarized papers that you are against his wishes.If he will do it he will be responsible for violation.If you have sole/or full/ legal custody he does not have any rights to decide whatever.

Hello,
First, you are not married to this guy, right? If this is the case then you have total custody of your son. The mother of any child in this situation has the total rights to make all choices for the child.

Second the only way that can change is if the father of the child takes the issue to court before a judge and the judge give him joint custody. He can never get total custody of your child unless you are proven an unfit mother.

Third by the time he realizes to take you to court and by the time the court decides to hear the case the baby will be born and too old. The safest time to circumcise a baby boy is on the circumcise day after birth. You can have them circumcised after that but it is not recommended for it can cause other health issues.

My suggestion is to say nothing to him about this and just give birth to the child and tell the doctor that you do not wish the baby to be circumcised and then by hospital laws they can not do that. He is not married to you and therefore will have a hard time overriding your wishes.
