YEs, they will garnish any joint assets, so your husband should get another account in his name only now.
Any account that has your name on it, either singularly or jointly with someone else can be garnished.
Based on the previous answers it appears there are jurisdictions where joint bank accounts are garnishable but be advised that this is not a universal principal.
In Ontario, where we practice, joint bank accounts are exempt from garnishment, however, it often requires a court order after the fact to stop the garnishment.
We suggest you look into the laws governing your particular jurisdiction.

But your ex-husband will be screwed out of any money of his that he has being deposited into that account, all going to pay off your judgment. You get the last laugh in that regard but it may create a situation where your child support is delayed and it would honestly be due to no fault of your ex.
That just happened to me too. Ar you legally separated? If not then they can take the money. I just learned that they can not garnish a bank acct. if a third party is not involved in the debt (with the exception of your husband) but if you add a child they can't touch it!Quote:
