    1099 without receiving check
    Can someone file a 1099 for me if I never received any money from them? What are my rights and what am I supposed to do? I worked as an intern and the company wants to give a 1099 by the end of the year. I never received any money/check from them.

    If you worked for the company, then how did you get paid? Could be they have to file a 1099 to keep everything straight seeing as you were an employee for a period, but you post is a little confusing.

    Tickle, I worked for free. It was a non-paid internship for a couple of months.

    Well then the l099 is just a formality because your name is on the employee records so they have to account for you somehow.

    That is NOT the point. Form 1099-MISC should NOT be filed if no income was earned. The receipt of a Form 1099 will require Gar01 to file a Form 1040 (instead of the much easier Form 1040EZ) and a Schedule C to properly account for the Form 1099.

    Gar, go to the payroll department and ask to speak to the head of payroll. Explain that a Form 1099 should NOT be issued if no income was received.
