    Being sued by one of the creditors ven
    My name is Sharon Harrison and I am enrolled in an debt settlement program with able debt settlement inc.

    On August 1st I receive a summons to go to court Sept 4th of this year from one of the creditors that refuses to cooperate with my program or acknowledge the power of attorney that I have in place with the debt settlement company. I know I have to go to court but what can I do to help myself when I do go to court? Could they win and make me pay late fees etc. I feel pretty helpless. Because I still don't have the money and the bill is an unsecured debt of court and I am trying to avoid bankruptcy. They are the only ones who refuse to cooperate. I really need some help. Since I began I have since retired so I have no more money than I started with.

    Is this a debt incurred from a relative that you had the power of attorney for ?

    I will assume you gave POA to this settlement company. A creditor is not bound to agree to anything but payment in full or as the contract says. So they do not have to ever accept the terms a settlement company asks for. They will note their POA but just are not bound to agree to any terms for less than their contract states. So your settlement company should have notified you of this, and made or tried to make arrangements to pay them their full amount if you could afford that.

    Yes they can sue you and yes if this is a valid debt they can and will win.

    Perhaps you can start back to work on some level to make enough money to pay these people?
