    Hit by an uninsured driver in Illinois
    I was recently hit by an uninsured driver with an expired license. There were no injuries, however, the damage to my car is great. The driver has admitted fault, and a police report was filed, however, the accident occurred on private property, so no tickets were given. If the driver is unable to, or refuses to pay, and I file a claim with my insure, will I be forced to pay my deductible, and will my rates go up?

    Depends on your insurance company. You'll probably have to pay the deductible, but your rates should stay the same since the accident was not your fault. As long as you have the police report with the other driver admitting fault, if he refuses to pay, take him to court to recover damages.

    Do you have Uninsured Driver coverage? In any event, your insurance company (the person who has been assigned to your case) will deal with the other driver (You shouldn't have to.) and will keep you informed on the progress of the settlement.

    Well, the police were unable to come out, so we were forced to go to the station. Surprisingly, she agreed to go. At the police station she started to complain of chest pains and shortness of breath, so she was taken, by ambulance, to a hospital.

    The officer writing the report said he would finish getting information from her later, but he clearly seemed to agree that it was her fault. He said he would call when he had finished, so we would be able to get the report, so I don't have it in hand yet.

    So you think it's best not to file with my insurance company?

    What if I take her to court, but she can not afford to pay?


    Wondergirl: I am not sure if I have Uninsured Driver Coverage. If I do not, would I have to pay my deductible, and would my rates increase? Same questions for if I do have Uninsured Driver Coverage.


    I have a high deductible, and if the damage costs as much to fix as I expect it to, I can not afford to pay it. What can I do to make sure she has to pay for all of the damage she did to my car?
