    My daughter is separated from her husband... no papers have been filed, she left him and came to stay at my house... her name is not on the condo title because he purchased it before they got married, approximately 10 months ago ( he took a job in Chicago and moved there 2 months before they were married... after they were married she also moved from Atlanta to Chicago )... we went to get her clothes and personal items and he had changed the locks and left a memo with building security that she was not allowed on the premises unless he escorts her personally... the police came and offered to oversee the process as he was out of town at the time, however he would not give permission for us to go in the condo... the cop said that even though she had lived in the condo for the last 8 months, it was in his name and she couldn't gain access without his permission... is this correct?? Does it mean he could have put her out on the street at his discretion?

    Hate to say it, but since her name is nowhere on the title, she does not have rights to access to the premises. She should obtain a court order to retrieve her things. If he does put her things out without returning them, she would be able to recover losses. I hope this hasn't been too long since she has left, because some judges would consider it abandoned property after a certain amount of time.
