    How about arrears?
    My ex is applying for social security disability, in the meantime, he hasn't paid his support payments or the arrears. If he is eligible for disability, will we receive the arrears and how do we get repaid?

    Hello mom:

    I doubt whether they'll deduct anything from his SSI. If he's disabled and on welfare, I doubt whether you'll ever get paid.

    Social Security is exempt from garnishment, so no child support payments can come directly out of his SSI. However, he is still responsible for paying the arrearages one way or another. He may apply for a reduction in the amount he's supposed to pay based on his disability but, if granted, it wouldn't apply retroactively.

    If you have a court order, your child support should come out of the SSD-child support can come out of disabililty insurance payments if that is what he qualifies for-again, SSD income can be garnished under certain circumstances.
