    Leaving the state with unborn child
    My friend wants to leave the state and move back to her hometown. She is pregnant and no longer with the father. She has told him that she is planning to move back home. He has not shown any bit of interest in the pregnancy until now. He has told her that she can't leave and that he already has rights. Is this true? What are her rights?

    If there is no custodial agreement then I imagine she could move where ever she wants any time she wants.

    Technically, he has no rights until the baby is born and paternity is proven. Does she plan to file for child support? Keep in mind that, if she ever applies for public assistance, she'll be required to. Also, once the child is born, the father can petition the court for visitation and/or sole or joint custody. That may place limitations on where your friend can live and/or relocate to. Once he's proven to be the father he does indeed have rights which your friend will have to honor or face possible contempt of court charges.

    I'm not sure. As I stated he has not shown much interest until now when she told him that she is leaving to be closer to her family for their support during this time in her life.

    Since she is still pregnant - she can move. Like others have said - there is no order in place and until paternity is established - she can basically do as she wishes. Now when the child is born, other things can happen. But as for moving right now - she can.
