    How to change the last name of a child ? The Parents have never been married .The child is in her Mothers care?

    She is 2 1/2 years old. Lives in Sc . Her father has never supported her and has not had much to do with her

    So what do you want to change the name from? Does she have the father's name? Is that what's on the birth certificate?

    If you want to change her name legally, you will need to file a petititon with your local Family Court (they can give the details). However, you can use any name you want to as long as there is no intent to defraud. So yuou can just tell people that's the name you want her to use.

    She has her fathers name on birth certificate .Would like to change it to her mothers name

    Again to legally change it you will need to go to family court.

    Hi, I am going through the same thing.
    Regardless of who has full/sole custody, regardless of if the parents were married or not, and regardless of who's last name the child has... the mother HAS to have consent from the father in order to change the child's last name. If the father does not give consent you could take the matter to court and try to prove why it would be in the best interest of the child to change the last name.

    I gave my child MY last name because her father and I were never married... I have full custody of her, and recently got married... I still am going to have to get her biological fathers consent to change her last name or take it to court and try to fight it.
