    What to do with my charged off car.
    I have a car that was charged off in a bankruptcy. I lived in Missouri and moved to Texas and am moving back to Missouri. They never came to get the car after the charge off- so I just have this car sitting around. What can I do with the car? What are the ramifications if I leave it behind? I tried to donate it- but since it was on a bankruptcy they couldnt' take it. I do not want to transfer this car back to Missouri.

    Was it DISCHARGED or CHARGED OFF. There is a difference between the two. A charge off means that the creditor took a tax loss on the loan but the debt is still owed. A discharge means the debt was negated as part of the bankruptcy.

    I would go back to the lawyer that handled your bankruptcy and ask whether you own the car or not. If the creditor still owns the car, tell them to repo it. If you own it, you can do what you want with it.

    It was charged off prior to the bankruptcy because I could not make payments. I included it in the bankruptcy filing because I didn't know they had charged it off already. If I just leave the car in Texas what will happen? I am in the process of leaving an abusive marriage.. if I leave the car- can my husband do something with the car to get me in trouble? This car is what's hindering me from leaving.

    If it was charged off and not discharged then you may still owe on it. Again, go back the attorney who handled the bankruptcy. Is the title in your name?
