    Probation Law
    In California can a probation officer overrule and go against what the court has ordered? Any help would be useful! Thanks!

    The probation officer may question, they may decide in the ways to inforce it. If you can be more specific it will help.

    For example if the judge orders drug tests, the PO may determine when and how and where.

    When I first had my arraignment I was told by the court not to use the internet at all. Now that I have been put on probation and such, my PO was saying that it was still court order that I stay off the internet completely, and with that being a hardship on my career, I went to court in April of this year to get it modified. The judge and the DA both agreed that there was not a court order in effect nor was it a stipulation of my probation to stay off the internet and I have the court papers saying that internet usage is okay. My PO told me today that I can only use the internet for career purposes even though I have paperwork from the court stating otherwise. Who is right?? Thank you for helping out! I really appreciate it!

    Hello Power:

    Don't argue with your PO. You can't win. Just do your internet thing and if your PO violates you for doing it, the judge will let you out.

    Yeah, I was really cool, calm, and collected when I saw her yesterday. I know there is no point to argue with her because she is "always right" in her mind. Thank you for your help!
