    twenty years
    Child support enforcement
    NYS child support enforcement. My ex works off the books, owes Uncle Sam $100,000. Ordered to pay 222.00/month in May 2007. During June and July missed 4 weekly payments (not consecutively) No company to garnishee salary (works as real estate agent) No tax refunds to take from him. Ordered to pay health benefits and has not so far. How is the enforcement made w/o me using another vacation day to get this done. The arrears just go up but no action taken. How many payments does he get away w/o making before action is taken?

    You need to go back to the court and have him cited for contempt and arrested.

    My mother went through the same thing. She has been fighting my father for over 17 years. You have to be your own advocate. The state workers who deal with child support enforcement are overworked and can't keep an eye on all the balls. You have to be the one in their face all the time demanding something gets down.

    You really have to take the reins that was how my mom was able to collect back support and alimony. My dad still owes her over $150K but she is going to get every penny.

    It's sad that the enforcement system isn't better the kids are the ones who suffer and its just so sad.

    You can return to court and ask that he be found in contempt. He obviously does a pretty good job of keeping himself "collection proof" by working off the books. Ultimately about the only thing that can be done is to incarcerate him for non-payment. Of course, if he's not paying now, he certainly won't pay once he's in jail either.
