    Unlawful detainer-VA
    Tomorrow I am going to the court house to file a UD. I do have a couple of questions since it is my first time going through this process. I am going to declare the unpaid rent for July, but can I also include the unpayment for August since the court date will be held in a few weeks?
    If I can not include that debt, while waiting for the court date shall I give my tenants a second 5 day notice in August and file a new UD? Or do I have to wait till the first suit is resolved?

    When you file the UD, include ALL charges you want to collect, right up until the court date. Include unpaid rent, late fees, everything. The clerk at the court house will probably explain this to you (mine does), but it's good to know before you go. You will get assigned a court date when you file, so figure out what the rent is per day before you go to make you calculations easier.

    Also, when you go to court, bring a copy of your lease, the 5-day notice and how it was served, and any relevant communications to the case. MAKE COPIES because the court will take these documents and attach them to the file. Again, the clerk should tell you this, but not all of them do.
