I am about to file to get my daughters father rights taken away because he has not seen her, does not want to see her, nor does he want anything to do with her. I live in the state of Texas and would like to know what forms I would need and how would I go about filing them.

I would consult an attorney. In most states parental rights to visitation, nonpayment of child support, etc, are completely separate from his natural right to be the father of the child. Unless he poses a danger to his child, most states will not allow his natural rights to be taken away unless he consents. I adopted my wife's natural child, father had only paid $200 or $300 in child support by the time she was 7 or 8 yrs old, no medial or other bills and was approx $20,000 behind in child support payments. Even then, her father had to give his written consent to allow me to adopt her. I had an atty next door neighbor and he gave him 10 days to sign consent or pointed out that the mother would actively pursue back payments but would fogive those back payments if would sign consent to adopt. Hope this info helps but again, it's best to at least consult an atty for many different reasons.

What makes you think you can do that? YOU cannot force a bio parent to give up their rights. This has to be done voluntarily, except in cases of abuse or where the parent represents a danger to the child.

If the bio father doesn't want anything to do with her, then, by default he has relinquished his rights, so why do you need to formalize it?
