    Married and Moving (Separating)
    I am married in the state of Virginia and would like to separate from my husband due to drugs and alcohol abuse. We have a 5 year old, but we were not married when I had her.
    I would like to know if I can move (in VA or possibly out of state... PA where it is much cheaper) with her. Is this legal? What should I do first before I move? Thanks so much for your help... you are a GODSEND!! c.

    It doesn't matter if you were married prior to the birth of your child. You need to contact your local Family Court and request an emergency hearing due to drug abuse by your husband. The judge should issue you temporary full custody and you can address the issue of moving then. You can also consult a divorce lawyer for further advisements on what you need to do to prepare yourself for court. Also, keep a record of your husbands activities with dates, times, and actions. This tool is very effective in establishing how responsible he is with your daughter. Good luck to you;-)
