My mother passed away over a year ago and her lawyer talked me into putting her house up for sale asap, since then, we have cleaned it out and got it ready to sell but the realtor renewed the listing and hasn't done anything to try and sell it, so I want to know is how do I go about breaking the listing with this company? I have talked to the realtor but she said she would have to talk to her broker but now she won't answer me back! Help!

What exactly do you want the broker to do ? Make a list, and go in person to see the broker. Advertise in the paper, hold a open house.

Have you had the home professionally appraised, have you compared it to other homes that are being sold in that area. Normally if homes are not selling it is because they need a lot more work, repainting inside and out, major repair, or the asking price is higher than the current actually market value, ( not appraised price, but actual selling price of homes in that area) There are several homes in my sub division that have been for sale for over 5 years basically for one of those two reason

Check your contract with the realtor. The contract should specify just how long the listing is held by them. Should also specify any terms of breaking the contract. Usually realtors are pretty sharp when it comes to their own pockets and have those things iron clad.

You would have to show proof of the home not being shown or why it is not being shown. If there is something additional you need to do, then the appraiser and/or the realtor should have told you. How did the realtor renew the listing without approval? Those kinds of agreements are signed by both parties.

Even if you found a buyer for your Mother's home, on your own, you still may be liable for the realtor's commission, since it is still listed. Please go and speak to your broker and/or agent.
