    How long can the Police Freeze my bank account without charging me for a crime?
    5 years ago I was fired from my employer which was a bank on posssible suspicion of stealing money from the bank with another employee. Charges have never been filed and I haven't heard anything from the bank or law enforcement since I went in and gave them a statement a few days after being fired. How long can they still hold the money that was in that account and what can I do to get it back? I would truly appreciate any information anybody can provide. Thank you very much!

    You need to either get an attorney or talk to the district attorney to find out the status of the case. After 5 years the case has most likely been dropped and you should get the money.

    Its possible the account was frozen as evidence, but I'm curious as to who told it was frozen. Its possible it may not have been frozen legally.

    Hello miguel:

    Once the criminal statute of limitations is up, they have to return anything they confiscated. Of course, having to do it and complying with the law are two different things.

    I would find out IF the statute of limitations is up. If it is, call the police department and demand they act. If it isn't, I would wait till it is.

    The statutes vary from state to state.

    They can't legally freeze your money unless they have a judgement against you. How much money are we talking about here? I'd file a motion in either small claims or superior court and ask the judge to order the bank to unfreeze your account.

    I have to disagree with s_cianci. The account could have been frozen as evidence.
