    Early release for violation of probation?
    My boyfriend was just sentenced to 90 days in jail for violation of probation. He was supposed to have been given community service hours, but they arrested him and charged him 90 days to jail. I know this doesn't seem like a long time, however I am just wondering if the courts ever release early for violation of probation or should I expect that he serve the entire 90 days.

    On a 90 day sentence he must serve 60 days, you are given 1/3 your time off for good behaviour.he should have asked to do time intermitently,meaning serving time on weekends.He might still be able to get a TAP-Temporary Absence Pass from the institution that he is serving is time at. The TAP would allow him to get out certain hours for the purpose of work. Hope this helps you , Good Luck

    Thank you, hopefully his lawyer was aware of all of that and fought for that at his trial. He was at his probation meeting when they arrested him out of the blue, and now he is in jail. I hope that you are right and 60 days will be it. Thank you

    Every jurisdiction sets its own standards for earning time off for good behavior, otherwise known as "goodtime". Some states are generous - some are not. Plus, he could lose the goodtime he has if he's written up - a good possibility. And, he might have conditions he has to meet. I don't know. There are lots of different possibilities.

    However, you could call his lawyer, his PO, or the sheriff directly. Or, you could look up the law on the matter at your states website.
