    Filing full custody
    I was told today that I could file full custody of my 2 children because my husband abandoned them. He has visitation every other week and he hasn't seen them for 7-8 weeks now. He never returns their calls and he calls maybe once every 4-5 weeks. Can I and should I take him back to court for abandoning them? This is not right that he can just pop up in their life whenever he feels like it. Can someone please give me some advice? :confused:

    I am not sure who told you that but it is very likely untrue. Abandonment must meet certain lengths of time which vary from state to state but on average at least a year of no contact and non payment is required. I would call a lawyer in your local area to find out specifically but I doubt that you can do that.

    LINHM4EVER... yea somebody is misleading! You what type of custody do u have? Does the man pay childsupport? Were u ever married? How old r the kids? This is the deal: u need to go to court if not already done get a court order about vistation try to suspend them 1st. U need him to be out of the picture for at least a year if your kids r old enough to tell the judge what they want and how he is not there for them I'm having this problem now my x has been in out of our child's life since birth now he has completely stopped all contact I've been to court so many times in the last 2yrs it isn't even funny the judges want to give all the dead beat dads a chance I guess since I've been coming so much he decided it was time to SUSPEND his visitation rights but wouldn't give me SOLE CUSTODY isn't that a BLEEP
