    Can we still evict?
    My husband and I rented our house to relatives who have been late in every payment. Finally, when they were 2 months behind, we gave them an eviction notice listing as reasons: consistent late payment and nonpayment of rent. They paid the 2 months rent. We had a lease but it was voided when they became 30 days overdue. Can we still evict them when the date specified on the notice is up?

    Are you saying you lifted the eviction notice when they paid the 2 months rent? Just to cover yourself, issue them another eviction notice first before you take legal action. Then they can't say that the eviction notice they previously got was expired.

    If they paid all of the money due plus any late fees allowed in the lease, then most likely you can not evict them, The eviction notice for non payment normally allows for them to pay. ( pay or quit)

    You can only do exactly what the lease allows you. So read the lease, if the lease says you can, you can,
