My lease is over in June 30. We put in an offer to purshace a house and are still on negotiations with the owner of the property. My current land lord won't put me on a month-to-month lease until we decide if we can get the house or if we sign a lease for the apartment again. When my lease is over does it automatically go month-to-month by NJ law? Or can the landlord throw us out of the place on the 30th if we have not given her the renewal letter? I have already read the entire contract and this is not specified anywhere.

The landlord can't just throw you out but they can evict you. However that will take some time. I would go back to the landlord and offer to increase the rent and guarantee at least 2 months notice to allow you to go on month to month. Either that or sign a lease with a 2 month escape clause.

The landlord is concerned that the apt will be vacant if you can just up and leave with 30 days notice. So by offering a guarantee of 2 months that should give them time to find a new tenant.

Check the terms of your lease. In many cases, the lease automatically converts to month-to-month upon lease expiration. Also check the laws of your state. Insome states, the lease automatically converts even if the converion is not spelled out in the lease.

The landlord has no obligation to allow you to rent after the terms of the lease have been satisfied. He does not have to let you rent on a month to month basis. He does however, need to give you a 30 day notice to vacate.

No disagreement with either Scott or LILL. The conversion must be mutually agreeable by both parties. Having the conversion either explicit or implicit simply means that they do not need to renotiate a new agreement. Sorry if that was unclear.
