Repairs for damage from previous tenants
I currently live in Missouri. Recently our complex changed the rules regarding moving out. They sent out a letter that indicated that we, the current tenant, must make all repairs and clean the apartments to, "bring them up to the standards of the board." In the letter it when on to state, "We fully realize that the member currently trying to move out is not the member who caused the problem, but somebody has to be the first to address these problems." Specifically, the problem is with the quality of the previous thirty years of paint and dirt build-up.

It has been indicated that bringing the apartment up to the standard of what it was on move in is NOT adequate enough.

Several tenants have tried to move out, but the board has required them to continuously paint and clean. Even professional painters have not been able to meet this standard. The painter recommended by the complex even quit because his multiple attempts still did not meet the requirements of the board.

Is this legal for them to require this of the current tenant?

    Hello lisa:

No. According to your states landlord tenant law, you are required to leave the place broom swept.

The board can't force anyone to do work. If they did work, they did it on their own. You however, since you now know the law, can just walk away from your apartment, and when the landlord refuses to give your deposit back, you'll sue him in small claims court and you'll win.
