My wife wants to leave the marriage but she will not leave the house. I am not the one who wanted the separation, she is. However, for spite, she will not leave the house.

How can I get her out?

She has been physically and verbally abusive over the past 3 yrs. She suffers from MS and while the Dr.s say it might be the condition causing her to lash out, I can not take it any longer. I love my wife but cannot take anymore of this. She is not capable of taking care of the kids, let alone of a house. It is more suitable for her to go live with her family and for me to stay at the house with the children as it would be less disruptive to them.

How do I make this happen?

You can't if you jointly own the home, you will have to go to divorce court and fight over who gets the home. Also if she suffers from MS, you may also expect to pay her alimony if there is a issue of her taking care of her self.

Well yes you can have her removed but it will have to be done in court. You ask for a "kick out order" based on violence. You can get it before the divorce is final. That is to say if you can get it. So if you can prove good reason for it you have a good chance to get a judge to order it but it can be done. Check with a laywer.
