    Hello, Yes, I moved into an apartment in Portsmouth Virginia, the landlord did no work on the place at all, I have been painting fixing holes and all sorts of problems, anyway, I have gotten behind on rent due to expenses I have incurred in the apartment, The landlord has taken partial payment of rent , but now threatens me with legal eviction, Can you tell me after the process has started How long before he can actually have me out of the apartment, and can he actually process this if he has accepted and cashed the partial payment ? Thanks so very much

    Did he accept that partial payment as full payment due to the amount you spent to fix up the apartment? If so you would have had to get this in writing but a judge may take your side if you have all the receipts and before/after pics and believe the landlord just decided to get greedy.

    Unfortunately once he can get a judgement from the court to remove you it's uaully within a few days that you have to leave legally or be removed by the police. I think 3 days but I'm sure someone will correct me.
