    Giving up his parental rights
    My Boyfriend And I Recently Split Up For About A Month And He Started Seeing Someone Else And Now We Are Back Together And She Is Pregnant. He Has Agreed With Me To Terminate His Rights. If He Doesn't Even Sign The Birth Certificate Is He Still Responsible? Can She Still Use His Last Name?

    She can do whatever she wishes as far as naming the baby. If she wants to give the baby your boyfirend's last name she can, if she wants to give it your last name, she can.

    He can terminate his parental rights if he so wishes, but this will not relieve him of his financial obligations.

    I am sorry that he saw fit to make a child but wants nothing to do with it. I hope you see this and get on birth control because it will most likely happen to you too.

    You said he has agreed with you to give up his rights... why would you ask that he give up his rights to that child? To make you comfortable? Wrong move!

    At this point your boyfriend doesn't even have rights or legal obligation. He would have to be on the birth certificate, which she can put his name on without his permission. But even with that, for her to get child support, they will want a DNA (unless he admits paternity and signs willingly) and he will have to submit to it.

    A court will not likely allow your boyfriend to give up his rights, even if he wants to. The state would become the child's other parent in essence and they would assume his portion of the financial responsibility for that child. The state will NOT do that, so the Court will not grant it.

    I'm a bit confused... Why would you want to be with a man (I use the term loosely) who does not want to be responsible for the life he created??

    The baby didn't ask to be conceived, why should he/she be punished? On second thought, if this is any indication of how your man lives his life, maybe the child is better off without him...

    No matter what he will always be responsible. You have no right to ask him to give up his parental rights. That is none of your concern. It is his child and he is responsible for his child for the rest of his life no matter what you say or what the birth certificate says.
