    That should have been handled at the divorce. On the mortgage you are still liable. Why not on the deed?

    I'm Divorced. During the legal separation, I signed over all property rights to my ex. That was 4 yrs ago. Apparently, she is now 2 months behind in the mortgage payment and it appears that no new mortgage was secured in her name. I filed and was approved for a chapter 7 bankruptcy 2 yrs after the separation. Do I have any legal or financial obligation to the mortgage holder as my name has never been removed from the account?

    As long as your name is on the mortgage... they can hold you liable for it. And the negative credit for it being late or foreclosed upon.

    That's something that should have been done during your divorce as ma0641 has stated.

    Did you discharge the debt in your bankruptcy? The divorce decree is not binding on the lender. So as long as your name remains on the mortgage you are liable for the debt. You should not have signed over the property until the mortgage was paid off or refinanced.

    I recommend returning to court to get an order that she must either refinance or sell the home to get your name off it. She won't be able to refi so you will likely have a short sale or foreclosure in your future.
