    Child Support Modification/Massachusetts
    I am going back for an increase in child support (Massachuetts). My ex is remarried for the third time and has shared physical custody of his two older daughters from his first marriage, age 18 and 16; neither parent pays support.
    1) How much of his wife's income can be considered for my daughters child support calculation?
    2) He doesn't pay child support, how much if any can he take for his other two daughters?

    1.) NONE of his wife's income will be considered... however if she has substantial income they may determine that he has more disposable income to pay towards support. I would not count on that unless you feel that you can prove it... she does not have to tell you what she makes.

    2.) He is still responsible for supporting those children while they are in his house... the courts will take that obligation into account when determining how much child support he has to pay to you. Again I would not count on an increase unless you can prove that he is not responsible for any of the expenses related to his first two children... he may claim that he has college expenses or increased insurance costs due to their ages and the courts will also take that into account. Even if the children do not attend college... Massachusetts does allow child support obligations to continue until their 21st birthdays.
