    I have a nephew who has lived his whole life in my house. A few years ago he asked to move into the basement apt, agreeing to help with the bills by paying a certain amount monthly (no written agreement). He moved his girlfriend in about 1 year after moving downstairs, things were fine until recently they have become a financial burden, they have not paid in 2 1/2 months, she very senldom works, is home all day using the electric, water... etc... We don't want to continue living like this and would like them out. Legally where do we stand?

    Well if you didn't have a written contract between yourself and him... then legally its your home and your kicking him out. End of story. You've made no binding contract, therefore the law doesn't come into this. However, is it possible to give them another chance? To sit them down and explain calmly and nicely the problems at hand? If it is, try it. You might get a better reaction then you would just kicking them out. Kicking him out without notice or at least a talk, might end in bad feelings. That's something I'm sure you don't want.

    I would just tell them it's not working out and give them 30 days to find their own place. If they won't leave you might have to consider calling the cops to have them removed.
