I was the Maintenance Supervisor at a townhome community! And was terminated because I didn't pay the rent on time! And then was advised that the rent was being taken out of my pay! Which I offered to have done before I was let go! And was told they couldn't or wouldn't? But I actually never signed a lease here! And now they want me to! After I've lived here a month! I don't want to be considered a squatter! But do I not sign the lease? Am I considered a squatter? What rights do I have? Or what rights do they have to evict me? The power is still in their name! I guess they can turn it off? But could I turn it back on and stay? I'm sure they're going to go through the eviction process! I just was given a 3 day notice! But how does this happen? I don't even have a lease!?

One thing for sure, you aren't a squatter. You are a tenant. You have to be evicted according to the law of your state (if you are in the US).
But WHY didn't you pay your February rent? Didn't you get a paycheck for January? It's clear that the management doesn't mess around. There's another 100 people wishing they had your job. So go talk to them calmly and show some of your intelligence that got you the job in the first place, and bring this month's rent with you. If you have to beg people to lend it to you.

Fla. I was told I agreed on the new hire information packet? I didn't even live here then! So even with no lease I am held in agreement? This is a right to work state and I understand they can fire me for any reason! I just have checked about employers taking most of your pay for a debt to the company and its illegal! But I've still not been paid! But since they've taken my pay for rent! Does that mean they can't evict until the next month?

The big question is why haven't you been paid? You've been there a month. Are you paid monthly? Is the check mailed to you? We just aren't getting enough information.

its already a done deal! I tried to get them to take it out before I was let go! Yea I'm sure they've been in a similar situation before! But if they took it out? They could've before I was let go! Now I'm unemployed! And fired for it? It doesent make sense to me!? If they could've taken it out? Why didn't they do it before all this? I asked them to! But was told the company couldn't or wouldn't do it?

this is my dilemma! My check at Christmas was 2 weeks late! And I was told they were taking it back, taking out the rent and cutting me a new one! I didn't think this was legal? And this was the day my check was supposed to be here? How can this be legal? How does this or any company take back a check? Its ed weekly! And was supposed to be here a week ago! And I still haven't been paid!

This is very confusing. I'm going to try to get the facts down here. You were hired as the Maintenance Supervisor. Part of the job included a unit for which you had to pay rent. That's about all the facts I can read.

For some reason you were terminated after a month? What was the reason for termination? Were you told you had to vacate the unit? It sounds like you are saying the employment agreement was for them to deduct the rent from your pay. For some reason this wasn't done initially. So they cancelled the check to issue a new one. Is that correct?

Has the rent been paid? If so, for what period? If you got a 3 day pay or quit notice, then, if you don't pay what you owe, in full within the 3 days, then they can file for eviction.

I suggest you try to calm down and relate the facts of your situation so we can advise.

Yes! But there wasn't any agreement! At least to my knowledge? I even asked! And was told that wasn't possible!

Yes I was! I was terminated for not paying January's rent on time! After I was told it would be OK! I just don't understand why I was fired for non payment of rent! And then the very next day! The day I was to receive my check! Now they can do it? If they couldn't before? Why can they after termination?

You agreed that your rent could be paid from your paycheck. They apparently agreed and deducted your rent from your paycheck. I'm not reading that there was any time frame connected with that agreement. You (apparently) didn't tell them to either take the deal now or not take it at all.

They then terminated you for whatever reason (and they don't really need a reason) and are evicting you because you paid your rent late. Maybe they feel you are irresponsible because your rent was late and they don't want irresponsible people working for them. Maybe not.

They are entitled to evict you.

You were a month-to-month tenant. You didn't need a lease.

Wow! I didn't think I would get such a bad response? I'm not a bad person and I was told I was an excellent employee! I had a problem with my bank account! And I didn't move in until the second week of January! The December check was late because they sent it to the wrong address according to them! Anyone would be upset about this and having to go throughout Christmas without being paid! The problems I had with my bank account was almost 3 weeks ago! And I told the manager about it and was assured that it was not a problem! But all of the sudden it was? I was just told by the HR department that if I vacated by Friday I'd be paid in full
For my last check! And I was advised that they cannot turn off my power! And would have to legally evict me! I don't need a response to that! Just stating the fact! I'm just hoping that something bad like this doesn't happen to anyone else! Especially a Family! It would be horrible to put a Family on the streets for no reason! It's sort of like the boy who cried "Wolf!" If you use an exclamation point at the end of every sentence or clause, the exclamation point tends to loose any meaning.

As far as I can determine, every state is an "at will" employment state. This, by the way, is different from being a "right to work" state. That means a state which prohibits an employer from conditioning employment upon membership in a labor union.
