    It IS discrimination, period...

    The problem is that unattentive fork lift operators AREN'T in a protected class of people like, for example, black people are.

    Discrimination is not illegal unless it is against a protected class. I could go into work today and fire everyone with a nose ring if I wanted to.

    Or go in and fire every third person, or every red haired person.

    Fair, not a bit, but they are not protected classes of people.

    And causing a accident is normally grounds to file.
