    Shared custody and changing schools?
    I currently have shared custody with my ex I just gave him notice that I will be moving 20mins away and that my son will be changing schools but he does not agree and wants to keep him at the same school but that bares impossible because I have 3 other children that will also be attending this new school and both schools start at the same time do I have a chance or what are my chances on fighting this in court

    So what exactly is the custody plan for shared custody ?

    Is it every other week, so many days during the week ?

    How will the other parent get the child home to their home ?

    Many shared plan do not allow for movement out of a school district for school age kids unless there is agreement.

    And you may be required to give more time to the other parent, if this makes it too hard for them to do certain days.

    How far is the new school from their home ? Currently how do the kids get from the school to the other parents home ? Do the other parent drive and get them ? Do they ride a bus, do you take them.

    20 min away, for the other parent will be 20 min one way, and then 20 min the other, So depending on traffic, you could be adding perhaps a hour more to get the child and to take them back. This reduces visit time, adds cost to the other parent, that you may be asked to pay for and more.

    So yes, moving 20 min away and a new school district can be a very big deal and a court battle.

    He could get a temp order to stop you moving the child, till the court hearing takes place.
