    How to change children's last name
    I have twin daughters that are 2 1/2 years old. Their biological father hasn't seen them since they were 6 months old. He does not stay in contact either. Only pays child support when he gets his license taken and has to pay it in order to get the liscece back. When the girls were in hospital after birth their last name was my last name.But their biological father signed the papers to make sure they had his last name.Me and their father were never married.As far as I'm concerned their last name is my last name but on insurance and birth certificate they have his last name.How do I go about getting their last name changed back to my last name?

    Sorry but what you believe makes no difference, what the birth certificate says is what their name is.

    You will have to get the fathers permission to change their names.

    I don't know what you mean by the statement "...their biological father signed the papers to make sure they had his last name." You can name your child anything you want, married or not; him signing a paternity acknowledgement does not give the children his last name unless you chose to do so.

    Getting back to the question, you can petition the court for the legal name change of a minor but as Fr_Chuck said, their father needs to consent to it.

    What I mean by that statement is that he filled out all of the paperwork using his last name due to me being in recovery for 20+ hours after the delivery.The whole time the girls were in the hospital they stayed with my last name.But yes his last name is on their birth certificates.And in the condition I was in after giving birth to them I most likely agreed to puttin his last name on there, not knowing that he would stray away after 6 months.But Thanks for your answer.
