    Mother refuses paternity test?
    I'm in a situation where my ex girlfriend cheated on me and she recently found out she was pregnant. The child is not due until October, what if she refuses a paternity at time of birth what legal rights do I have? What can I do it could very possibly be mine.

    You go to Court and ask for visitation after the child is born. The Court will order DNA testing.

    You, of course, will be responsible for child support if you are the father.

    You don't need the mother for DNA test. You only need the baby and the father. Having the mother also is a bonus but not required for a outcome to be realized.

    Check to see if your state has a putative father list.

    If so, get on it.

    You'll probably also want to get a lawyer, and go to court once the child is born to set up custody, visitation, and child support.

    As noted, the mother can't "refuse" if there is a court order for the test, and you have to use a lab approved by the court.
