Hi, now after paying child support since October, My daughter has returned to live with me, because her Mom and her don't get along and fight all the time. The Child support payments have caused me the need to file bankruptcy & I haven't been making enough money to pay my mortgage payments, so I been selling my stuff off at pawn shops to make up the diffence. **** Now my question would be How do I end the child support payments to my ex-wife? I heard there might be a way to get a emergency hearing? ****

    TIA

Was the custody change done through the courts ? If not your going to have to do that also. You can file for emergency custody and you should also notify the child support agency that the child is living with you now. At that time ask for child support to be set aside or lowered or recalculated based upon new facts. Is it that you each have 1 child living with you ? If your payscales are close they should set aside child support until a hearing.

On a side note many mortgauge companies are allowing refinance of the loans even under extreme conditions. Yours qualifies. You might want to look into that. It would catch you up and also avoid bankruptcy.

You need to go to establish having custody legally, then support will also be redone.

    Thanks,
My oldest child is married, there is only the youngest one she's 17. The change of custody wasn't done in the courts yet. Do you know what forms I need to file for emergency custody?
