Sounds like the attorney did just the right thing. Good luck. This will buy you some time, document your pretty little head off. It's the only thing the court pays attention to. Facts, not allegations.

    Hello again, mrs:

I know you're between a rock and a hard place. I think you're doing the right thing. I didn't advise going against the court order. THAT wouldn't forward your cause. But, you ARE doing things, hopefully some of which will bring you and your children the relief you so deserve.

I have read all this and am going to put in my 2 cents worth minus inflation.

Go get a loan as someone has sugested ( in your works make payments over time ). Start the process. Bring forth your alegations. When you get in front of a judge be sure in your paperwork to ask for a parental evaluation. You ALL will be evaluated. You the kids and him too. They have much more time then CPS to look into things. Its cheaper then dragging things through the courts over and over. The evaluator can recommend a modified visitation and can make sure he gets what he needs before visitation increases if its taken away.

BTW: what state is all this in ?

We are in Texas. I can't get a loan, being married to this man, well made my credit lower than dirt, my parents have paid out the butt to get stuff paid off and I am trying to get my credit cleaned up, but at this time I can not even get a rapid refund loan. So a loan is not an option. I have spoke with legal aide and hopefully they can help, I am not sure how much help they can be, I am afraid that being legal aide, it may not be as helpful as I want.

    Hello again, mrs:

The economy is in shreds. Lots of people are out of work. That means lawyers too. I'll bet you can find one who will represent you and take payments. No, you're not going to get the top guy in a downtown lawfirm, but if you shop well (and it ain't going to be easy), I think you can be successful.

I have been calling around and the smallest retainer I can find is 500. I will keep looking. Legal Aide called back and said they could take the case. I am not worried about the attorney, the facts speak for themselves and I have covered myself enough that most to all allegations are documented either with CPS or the kid's therapist. And I document everything when they return or anything they say and when they say it, big or small. So I feel that the facts should speak alone and I have reputable witnesses including doctors school teachers nurses officials, friends, and even some of his former friends that no longer speak to him due to this mess. I am not out to smear him, judges don't like you to go into to court pointing the finger and being there just to make him look bad, I am only looking out for the best interest of the children and only will state the facts that are known to be true and asking him to answer to the ones we are unsure about. That way he is held responsible for his actions and the children may be able to come out of this with some dignity.
