    Lawfare
Brazil's version goes like this . Luiz Lulu da Silva was the leftist establishment President of Brazil . He lost the Presidency to the Liberal Party candidate Jair Bolsonaro in 2019 . He began a process of economic reforms .That led to him being labeled a right wing threat to democracy.

They faced off again in 2022 . Lulu won a close election. That is normal elections in a free nation. But that is not where it ends . Bolsonaro is charged with plotting to stage a coup. Scores of his supporters were jailed after they rioted believing the election was stolen (sound familiar ?) . He is also charged with falsifying of vaccine records related to him travelling during covid.

Same thing with John Brennan and James Clapper

    Quote:

In 2011, then Homeland Security Advisor to President Obama, John Brennan, swore before Congress that drone-targeted assassination missions near the Pakistani border had not led to “a single collateral death.”
That was an obvious lie with grave consequences, given that Brennan was sworn under oath and was one of the top officials in the US national security community. Yet there were no subsequent repercussions.

In fact, the opposite occurred. Brennan was subsequently rewarded with a 2013 appointment as CIA Director.
But the next year, once again, Brennan lied to Congress, assuring the Senate Intelligence Committee that his CIA had not secretly accessed senate staffers’ computers. Again, there were no consequences for his repeated lies. Instead, Brennan, upon retirement, went on to be an MSNBC/NBC analyst who helped to promulgate the Russian collusion/laptop disinformation hoaxes.
In 2013, Director of National Intelligence James Clapper also lied under oath to Congress when he laughably stated that the National Security Agency did not spy on American citizens. Later, when called out by senators, Clapper fudged in a televised interview. “I responded in what I thought was the most truthful, or least untruthful, manner by saying no.” Try that contortion with the IRS.
Some members of Congress referred a criminal complaint of perjury against Brennan to then Attorney General Eric Holder. Nothing happened. Again, one of the chiefs of the American national security community was exempted after lying to members of Congress.
Clapper went on to a lucrative position as a CNN national security analyst, and at one point he claimed that Trump was a Putin “asset.”

No one has ever posted a half $billion bond before . On top of that the lenders are afraid of getting on the bad side of the NY justice system. So when Eric Trump went seeking a lender to post the bond ;he says he was laughed at .

I was listening to the Joe Paggs show today and made a pertinent observation to the effect that if they can do these things to Trump, then they can do it to anyone. It's just another symptom of an out of control fed government that needs to be reduced in size by more than a little.

The first part of the Stormy Daniels ' hush money or non-disclosure agreement is a campaign finance violation ' case that may or may not be enforceable by local law ... will be jury selection .

Someone needs to explain how an impartial NYC jury can be found . Trump's influence on the city began decades before he became an international celebrity ;politician ;and President . There is zero chance you can find an eligible juror who has not heard about Trump ;and has not formed an unbiased opinion .

Flashback 2015 . Bombs had been detonated at the Boston Marathon . Everyone knew that the accused ;Dzhokhar Tsarnaev ,and his dead brother had done it . Everyone in the city experienced the lockdowns during the manhunt. 2 months after jury selection had begun a jury was sworn in. Of the 12 jurors 4 admitted during their interview that they believed he was guilty. They made the cut anyway because they said that they could put their beliefs aside. (the other 8 were probably either lying or were too stupid to have been eligible )

Tsarnaev is not as well known as Trump and certainly everyone in NY has an opinion of Trump .

Martha Stewart was put on trial. It took a month to find a jury. The judge tried to prevent a media circus by barring reporters from the court during selection. 17 news organizations sued. The appeals court agreed their 1st amendment rights were violated . But since the trial had already concluded ,their opinion did not impact the trial.

But that ruling could impact this case. Already judge Juan Merchan has slapped Trump with a gag order .

I expect Trump to challenge that . Since he apparently will be spending a lot of time in court rooms instead of the campaign trail; he probably thinks it's important that he be given the right to speak out.

OJ Simpson was put on trial .It took 2 months to find a jury.

Michael Jackson was put on trial Jury selection took weeks and was postponed twice when a lawyer had a family member die ;and when Jackson got the flu . Finally after a 4 month trial Jackson was found not guilty .

None of the cases above comes close to the impact that this Trump trial will have .

Meanwhile in Georgia ;Trump's lawyer Steve Sadow argued the charges against Trump should be dismissed because Trump was exercising his 1st amendment freedom of speech when he challenged the legitimacy of the Georgia election results in 2020.

The prosecution contends that what Trump said was part of a criminal conspiracy to overturn the results . Trump's co defendants have tried the 1st amendment card already and were denied. That will be one of the bases for later appeals.

I have no doubt that the NY appeals court will side with James. Trump will have to fork out the fine PLUS interest that has been accumulating since the trial . In addition the judge ruled Trump can't conduct business in NY .

Sometimes the Dems accidently give us a glimpse of their true intent.

This happened in NY where a top spokesman for the US Attorney's office spilled the beans during conversations caught on tape. Nicholas Biase said he thought the charges brought against Trump were BS

    Quote:

“Honestly, I think the case is nonsense,” Biase was filmed saying to an unidentified woman on July 31 at what appears to be a bar.Biase — who said he’d known Bragg for 15 years and previously worked with him at SDNY — described the unprecedented hush money case against Trump as a “perversion of justice” in the footage. He also claimed the headline-grabbing prosecutor pursued the case to make a name for himself and run for higher office.“He wants to be, something … a mayor? I’m not sure what he wants to be, but I know he’s not happy just being the DA of New York County. Before he decided to prosecute Trump, did you know who he was? You do now,” he said in the clip.

Top spokesman for Manhattan US Attorney's Office caught on secret recording blasting DA Bragg over Trump prosecution (nypost.com)

    Speaking of Judge Merchan ;

“This guy is probably going to try to lock him [Trump] up. And there is going to be, it’s going to be ugly…,”
Biase said, in an apparent reference to Manhattan Supreme Court Judge Juan Merchan, who is overseeing the case.

“They are so obsessed with getting him [Trump],” he continued.Asked whom he meant by “they,” Biase shot back: “The Democrats … It affects his candidacy if he’s a convicted felon.”
But the spokesman said the apparent ruse backfired.
Those felonies did nothing to stop Trump from running … In fact, they made him [Trump] more relevant,” Biase said in the recording.

Speaking of the Letita James case against Trump he said “Every real estate person in New York does what he [Trump] did. Nobody’s ever been charged with this … You know, it’s a perversion of justice,”

“At the federal level, where I work, there is a 90-day rule where you can’t make any decisions on cases that are going to affect an election [within 90 days of an election],” he said.
“That rule does not apply at the state level because the state level is like the f–king Wild West … They are like idiots. They don’t care. They’re all political.”

But that's not all He also commented about the Georgia election interference case brought by Fani Willis
To put it mildly, it’s a mockery of justice. She is a joke … The whole thing is disgusting. They’re just out to get him [Trump],” Biase said of Willis.

When confronted with his words he backtracked . 'Hey I was at a bar trying to pick up a chick ' .

    Quote:

“I said these things in an effort to please and impress someone I just met, who was secretly filming me,” Biase said. “I’m deeply sorry to the local and state law enforcement officials working on these matters, who deserve more respect than I showed them. I should have known better.”

A 5 panel State appellate panel heard Trump's appeal of the ridiculous judgement against Trump and his business .

“I’m sorry, what’s being described sounds an awful lot like a potential commercial dispute between private actors,” said Judge John Higgitt .

“There has to be some limitation on what the attorney general can do in interfering in these private transactions where people don’t claim harm,” said Judge Peter Moulton

Other cases Letitia James civil case is still waiting for a decision from the appeals court . If any of it remains Trump is likely to continue the appeals up the ladder . Given that Guv Kathy Hochul called Trump supporters unAmerican ;she would be wise to make a blanket pardon for Trump. Will she ? Nahhhh

Judge Chutkan dismissed the case .

3 special prosecutors . $90 million spend by the Feds trying to get Trump . The Feds are 0-3 (The document case in Florida is also dismissed) .

Trump is NOT indicted in any Federal charges.

The one remaining question is ;were the prosecutors legally and constitutionally hired by the DOJ ?
The appointments clause (art 2 sec 2 clause 2) says Smith and before him needed Senate confirmation.

and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

Judge Cannon in Florida ruled Smith was improperly appointed by AG Garland .That was being appealed before the dismissal.

“The Special Counsel’s position effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers,”
    gov.uscourts.flsd.648652.672.0_4.pdf

There is no statute establishing the office of Special Council . Garland argued that Smith was an "inferior officer" that does not need confirmation.

The truth is that there has never been a case where a special council has been appointed who was not a political hack. The whole concept of a special council as it currently is exercises is unconstitutional.

Trump's codefendants in the document case Walt Nauta and Carlos de Oliveira.still have their cases active . So the appeal still needs to be ruled on by the Court of Appeals.

Larry Kudlow skewers the Hunter Biden pardon and glowingly praises Trump's selection of Kash Patel for DOJ

    Quote:

The fact that the Biden Justice Department tried to put Donald Trump in jail for 750 years, with their weaponized lawfare attack that never had any merit at all. All of this shows why it is essential to clean up the Justice Department and the FBI. Now, bring on stage Kash Patel, who President Trump is nominating for FBI Director.

Patel is Mr. Cleanup. He is a brilliant guy with vast experience in law, national security and fighting crime. He will come into the FBI not to take revenge, or wage a new weaponization, but instead to cleanse the agency, to clear out all the deadwood because, right now, the FBI is caught in the throes of its greatest corruption period since J. Edgar Hoover and this must stop. It must be ended. President Trump knows this and Kash Patel is exactly the guy to do it. Take a listen to this tape from our show two weeks ago:

KASH PATEL: "The worst weapon we have in government is a two-tier system of justice that's been weaponized, and I think it's time that Donald Trump came in there with a sweeping mandate that the American public gave him to return a singular system of constitutional justice. Here's the thing. There is no revenge list. If Donald Trump is successful, he will make these institutions – the FBI, DOJ, D.O.D., successful forever."

Kash Patel famously uncovered the "Russia, Russia, Russia" hoax financed by Hillary Clinton, supported by the FBI, and cooked up by their crooked mouthpiece, Christopher Steele. Kash Patel has served as Senior Director for counterterrorism at the National Security Council, Deputy Director of National Intelligence, and Chief of Staff at the Defense Department. He has tried over 60 jury trials. He has been both a prosecutor and a public defender. So, he knows all about domestic and international crime.

He is exactly what the FBI needs and Kash Patel will work closely with Pam Bondi, the brilliant woman and former Florida Attorney General who will become President Trump's Attorney General and will work hand in glove with Kash and other new officials to clean out the dirty stables of justice that has regrettably prevailed in this country for the past four years – if not longer.

Despite Trump's victory and promises to pardon Jan 6 protesters ; prosecutions and trials are proceeding ,probably at an accelerated level of urgency.

I oppose blanket pardons and that includes the protesters . They should be evaluated on a case by case basis. Pardons and commutations should be granted to those who did not participate in violence or vandalism.

As expected Bragg wants to delay the Trump sentencing until after Trump leaves office.

Letter to Merchan Nov. 19 | DocumentCloud

Then I assume that judge Merchan will sentence Trump to jail for the rest of his life. This is being spun as a victory for Trump because if the judge agrees ,Trump won't be sentenced next week

I won't believe this is over until the case is dismissed .

Pretty good statement. I would only add that the fact they have, in some cases, been held in confinement for close to four years now That should be taken into consideration for at least giving them a release from charges. Something like 400 of the cases have been settled or prosecuted. From what I could see, I don't know that I would have proceeded with charges against 400 people.

    some more lawfare news

DOJ Inspector General Office released a report about the Jan 6 riot.

    25-011_0.pdf

Despite withholding this information ;the FBI had 23 confidential informants mingled in the crowd of protesters . They had strict instructions to stay clear of the Capitol Building

. Thomas Massie on X: "For years I was called a conspiracy theorist for asking Garland, Wray, and Horowitz whether government assets participated in J6. Yesterday I was vindicated. DOJ IG report confirms there were FBI confidential human sources in the crowd, entering the Capitol, and breaking laws. https://t.co/0spxGu6Wt9" / X

4 of them entered the building and 13 entered the restricted area around the building. None of them have been charged .

Although these informants had given details about possible unrest ;none of the information was acted on.
Informants embedded with the Proud Boys claim that have no knowledge that the riot was premeditated. Instead the Proud Boys biggest concern was confronting ANTIFA if they showed up.

Trump sued George Stephanopoulos and ABC for defamation over a report he gave claiming Trump was found liable for rape in the E. Jean Carroll law suit. He wasn't . He was found liable for sexual abuse; a charge he claims is false.

A judge ordered Trump and Stephanopoulos to sit down for 4 hours of deposition for discovery.

Instead they are settling . ABC agreed to pay $15 million to Trump and both the network and Stephanopoulos have made public apologies.

The FBI spied on Kash Patel when he was a staffer for Rep Devin Nunes “between September 2017 and March 2018,” . This was a time when Jeff Sessions recused himself from the Russia hoax ;and Andrew McCabe ran roughshod over the DOJ . He compelled Apple and Google and other social media sites to turn over to the FBI private information . They were trying to find out if Congressional staffers were leaking to the compliant press information about the Russia hoax investigation.

Kash was lead council for the Repub Congressional investigation . The FBI got a gag order preventing the sites from informing him that he was under FBI surveillance.

The IG report came out Tuesday . Wednesday FBI Director Chris Wray said he was stepping. down. When Kash becomes FBI director some investigators have some 'splainin' to do .

More Trump winning . Jeff Bezos ;who Trump has sparred with for years is coming to Mara Lago to grovel . During the campaign as a preliminary more ;he killed the Compost's endorsement of Kam the Sham. Hedging his bets he decided that the paper would not make an endorsement .

Now that Trump has one he comes paying tribute to Trump with hands out begging for forgiveness and Trump's good graces. Seems the Compost and his other business interests ...Amazon...Blue Origin ..could gain or lose based on Trump' say.

You also see this on Wall Street where they gave Trump a hero's welcome when he rang the bell at the stock exchange standing next to a blow up poster of his Times Man of the Year photo.

The masters of the Universe like Bezos are like typical rent seekers looking for their slice of the pie.

The lefties at Salon are outraged .They conveniently forget that Hunter Biden was sent around the globe to peddle Clueless Joe's influence.

But when rent seekers nose up to Trump ;then he is suddenly autocratic royalty .

    Quote:

The coronation (or what we used to call the inauguration) hasn't happened yet, but he's already being feted like a medieval king. And unlike the British monarchy, which has eliminated the paying of tribute to the king, here in America — where we supposedly cast off such practices in our revolution — our new president is busily collecting payments and demanding fealty from his liege lords and foreign allies. And he's making it very clear that he will not be happy if they don't come across with plenty of lucre to fill his royal coffers.

Amazing . Despite Stephanopoulos causing the network to settle with Trump for $16 million , they agreed to sign him up for a new contract. Details were not provided but he is rumored to make $20 million a year .
I guess ABC has no fall back talent to step in and fill the roll of big talking head .
